These Terms of Service (“Terms”) constitute a legally binding agreement between Magieva Inc., a Delaware corporation (“Magieva”, “we”, “us”), and you or the entity you represent (“Customer”, “you”) governing your access to and use of the Magieva platform and services.
BY ACCESSING OR USING OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE OUR SERVICES.
You must be at least 18 years old and legally capable of entering into binding contracts to use our Services. By using our Services, you represent and warrant that you meet these requirements.
You must create an account to use certain features of our Services. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

The Services and their content, features, and functionality are owned by Magieva and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You retain all rights to any content you submit, post, or display on or through the Services (“User Content”). By submitting User Content, you grant Magieva a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of providing the Services to you.
Our Services use artificial intelligence to generate content. You acknowledge that AI-generated content is provided as-is and may contain errors or inaccuracies. You are responsible for reviewing and validating any AI-generated content before use.
We do not use your data — including User Content, prompts, and AI-generated outputs — to train our AI models or any third-party AI models. Your data is used solely to provide the Services to you.
We do not retain your data beyond what is necessary to provide the Services. You may export or delete your data at any time, and we do not retain it beyond that.
Certain features of our Services require payment. You agree to pay all fees associated with your use of paid features. All fees are non-refundable except as expressly stated in these Terms or required by applicable law.
We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAGIEVA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the “Last Updated” date. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
